Beatriz M. Carta, partner, is both a litigator and a counselor. Ms. Carta has extensive experience in representing companies litigating toxic tort and environmental cases throughout the continental United States and its territories. She has represented clients in toxic tort litigation involving alleged injury to natural resources, and to human health resulting from contamination to the environment when every day compounds such as gasoline and dry cleaning solvent and other toxic chemicals enter the environment. Ms. Carta has also represented companies in cost recovery and natural resource damages litigation under the Comprehensive Environmental Response, Compensation, and Liability Act, RCRA and related state laws.
Ms. Carta managed all aspects of the complex toxic tort and environmental cases including the development and implementation of litigation and settlement strategies. In the pretrial phase of the litigation, Ms. Carta managed the selection, preparation, development, depositions, and Daubert challenges of scores of experts in every environmental specialty, including: marine biology, hydrogeology, toxicology, geochemistry, natural resource economics, environmental toxicology, and industrial standards of care. Other recent work includes civil litigation involving an environmental indemnification claim related to the transfer of an industrial property, as well as preparation of post-trial appellate strategy and preparation of briefs before state supreme court related to Ms. Carta also represents companies and individuals in enforcement proceedings (administrative, civil and criminal) under CERCLA, Clean Air Act Clean Water Act and the Act to Prevent Pollution from Ships.
Ms. Carta also represents clients in a variety of non-environmental litigation, including complex business litigation involving claims of breach of contract, defamation, civil theft and other business torts.
